TERMS OF SERVICE

 

Congratulations on taking the first steps towards changing your health & fitness. It’s hard to understate the importance of what you’re doing, and we are beyond excited that you have decided to work with us!

Below, you will find our terms of service. These were developed with the goal of maximizing your success on this program, so it’s important that you are familiar with them. By doing business with Evolve Personal Training LLC, you agree to the following terms & conditions:

1. Health & Fitness Disclaimer

1.1. Not a substitute for medical advice

Our personal training services are not a substitute for professional medical advice, diagnosis, or treatment. We are not medical professionals, and our services should not be considered a replacement for consulting with a qualified healthcare provider.

1.2. Consultation with healthcare provider

Before starting any fitness program or engaging in our personal training services, it is essential that you consult with your healthcare provider. This is especially important if you have any pre-existing medical conditions, injuries, or concerns about your health.

1.3. Assumption of Risk

You acknowledge and accept that participation in physical exercise and fitness training carries inherent risks, including but not limited to the risk of injury, illness, or death. You voluntarily assume all such risks and responsibilities associated with participating in our fitness programs.

1.4. Disclosure of Medical Conditions

You are responsible for disclosing any relevant medical conditions, physical limitations, or injuries to us before participating in our training sessions. We will use this information to tailor our programs to your specific needs and safety.

1.5 Client Responsibilities

As a client, you are responsible for your own safety during training sessions. This includes following instructions, using equipment properly, and notifying us immediately if you experience any pain, discomfort, or unusual symptoms during a session.

1.6. Medical Emergencies

In the event of a medical emergency during a training session, we will seek appropriate medical assistance as needed. You consent to such actions in case of an emergency.

1.7. Liability Waiver

Except for instances of our gross negligence or intentional misconduct, you agree to waive any claims or liability against us, our trainers, instructors, or representatives for any injuries, damages, or losses that may occur during or as a result of your participation in our services.

1.8. Results May Vary

Results achieved from our fitness programs may vary depending on various factors, including your commitment, adherence to instructions, and individual circumstances. We do not guarantee specific outcomes, unless otherwise expressed in writing.

Please understand that your health and safety are our top priorities. Before beginning any fitness program or using our services, consult with your healthcare provider and understand the risks involved. By using our services, you acknowledge that you have read, understood, and agreed to this Health and Fitness Disclaimer.

2. Client Responsibilities Disclaimer

As a client of Evolve Personal Training ("Company," "we," "us," or "our"), you acknowledge and agree to the following client responsibilities:

2.1. Health History Assessment

It is your responsibility to provide accurate information about your health, medical history, and any pre-existing medical conditions, injuries, or physical limitations to us before participating in any training sessions. This information is crucial for our trainers to design safe and effective fitness programs tailored to your needs.

2.2. Safety During Sessions

During training sessions, you are responsible for your own safety. Please follow the instructions provided by our trainers, use equipment properly, and maintain proper form during exercises. If you experience pain, discomfort, dizziness, or any unusual symptoms during a session, you must immediately inform your trainer.

2.3. Adherence to Program

To achieve the best results from our fitness programs, it is essential to adhere to the recommended exercise routines, dietary guidelines, and any other instructions provided by our trainers. Your commitment and consistency are key factors in achieving your fitness goals.

2.4. Communication

Keep open and honest communication with our trainers. Share your progress, concerns, and any changes in your health status. This information helps us adjust your training program as needed.

2.5. Respect for Others

Show respect for our trainers, instructors, and fellow clients during training sessions. Behave in a respectful and considerate manner, and refrain from disruptive or inappropriate behavior.

By engaging in our personal training services, you acknowledge and accept these client responsibilities. Your active participation and commitment to these responsibilities contribute to a safe and productive training environment and enhance your overall fitness experience.

3. Payment & Fees

By engaging in personal training services offered by Evolve Personal Training ("Company," "we," "us," or "our"), you acknowledge and agree to the following terms regarding payment and fees:

3.1. Pricing Structure

Sessions are to be purchased up front, as a monthly “package”. Every 28 days (4 weeks) you will be charged for the agreed upon number of sessions for that 4 week cycle. If you wish to change your package, you must communicate this with us in writing before the due date of your next package. Prices are subject to change at our discretion, and any modifications will be communicated directly to the client, either in person or through text.

3.2 Payment Methods

All payments must be made through electronic funds transfer (ACH, credit, or debit), and will occur on the day that you are due. If there is any issue with this, it must be communicated to us at least 1 week before payment is due.

3.3. Billing Cycle

Billing will take place every 28 days. You will be charged for all sessions (up to 12) on the date of your first session in the new package. If your payment doesn’t go through, we will inform you and you will have 1 week to change payment methods or you will potentially have to concede your spot.

3.3. Refund Policy

Under no circumstances will refunds be given. If you sign up for a month of training, you will be expected to adhere to that agreed upon schedule and will be expected to take the loss in the case you cannot continue training.

3.4. Package Expiration

If you purchase a package of training sessions, the sessions must be used within 60 days. Unused sessions may expire, and no refunds or extensions will be provided unless otherwise stated in our policies.

3.5. Pausing Services

Services may be paused for extenuating circumstances, which may include but are not limited to - severe sickness, injury, or short term changes to your lifestyle such as taking care of a loved one, losing your job, etc. Specifically, short-term vacations (14 days or less) will not be considered a valid reason to pause services. In acceptable cases, you will be given no more and no less than a 30 day grace period, during which your spot will be reserved. After this 30 day grace period, you will have another 60 days to use your sessions before your sessions will expire.

3.6. Cancellation of Services

In the event that you wish to cancel your services, you must give at least 1 weeks notice in writing, before the date that you are due. In the event that you cancel before using all of your sessions in the package, you will not be reimbursed or receive any sort of refund for those sessions.

3.7. Additional Costs

You are responsible for any additional costs associated with your personal training program, such as an outside gym membership fees, equipment purchases, or special materials required for specific training sessions.

3.8. Disputed Charges

If you believe there is an error or dispute regarding a charge or payment, please contact us promptly to address the issue. We will investigate and resolve valid disputes in accordance with our policies.

4. Attendance Policy

At Evolve Personal Training ("Company," "we," "us," or "our"), we are committed to providing effective and valuable personal training services to our clients. To ensure the smooth operation of our training programs, and your success on those programs, we have established the following Attendance Policy:

4.1. Session Charges

Clients are responsible for the full session fee, as agreed upon at the start of their package, whether or not they attend a scheduled training session.

4.2. Cancellation Notice

If you are unable to attend a scheduled training session, you must provide at least 24 hours' notice to your trainer in advance of the session start time in order to make up that session.

4.3. Missed sessions with communication

If you miss a scheduled training session but have provided at least 24 hours' notice to your trainer, you will have the opportunity to reschedule the missed session at a later date, within a 60-day window. Rescheduled sessions may not take the place of previously scheduled sessions. Instead, they must be in addition to your previously agreed upon schedule.

e.g., if you have agreed to 2 sessions per week, and must cancel one of those sessions during a billing cycle, you will have to attend 3 sessions in a week during the 60-day window for it to qualify as a “make-up”.

4.4. Session Rescheduling

To reschedule a missed session with proper notice, please contact your trainer as soon as possible to arrange a new session date and time or use our scheduling app to reschedule.

4.5. No-Show Sessions

If you do not attend a scheduled session and do not provide the required 24 hours' notice of cancellation, you will be charged for the session, and it will not be eligible for making up the session. If this occurs more than twice in a month, you will be at risk of losing your spot.

4.6. Emergency situations

In case of unforeseen emergencies or exceptional circumstances, please contact your trainer as soon as possible to discuss your situation. We understand that emergencies can arise, and we will consider them on a case-by-case basis.

4.7. Trainer Availability

Session rescheduling is subject to trainer availability. However, we will make reasonable efforts to accommodate your request for a make-up session.
